I keep my qualifications and skills up to date with CPD, my membership with the Australian Kinesiology Association, professional indemnity and liability insurance, research the latest developments, and take all reasonable care and due diligence by committing to best practice and evidence based medicine. I take my duty of care very seriously by being a committed holistic health practitioner. If there is something that I cannot help you with, I will happily refer you to other services/practitioners so that your health care needs are taken of.

Your Responsibility
I work with the body’s innate intelligence and therefore your physical body must be well hydrated with no alcohol or non prescription medication in your system 12 hours before a one to one session or group session with me. It is important that you arrive in good time for each session so that I can accommodate all clients/students for the day. I understand that many of you lead busy lives and that your time with me is important. I will take all measures to see you on time, but please be aware that the nature of my work requires that I must ensure that my clients are grounded and stabilised before they leave my office. Please know that the care I take with each person is the same for everyone. Take responsibility for the self care that you have provided yourself in coming to see me so that we can make the most of your healing session /group work each time.

Important Information
Patience with your healing journey can test your patience! But all good things will reveal themselves at the appointed time. Each session may take up to 72 hours to fully integrate. In that time frame you may feel enormous relief from your symptom(s), sometimes immediately after a session, or other times it may feel that there has been a regression. Be aware that when working in the dynamic, holographic field that is quantum medicine each experience is different, neither good nor bad. Take ownership of your own journey, take recommendations, suggested natural products or alternatives that are part of your Home Care Plan (see below) into consideration, and if unsure please contact me for further advice or seek out further information and research what is best for you and your family.  Taking back the power of your healing into your own hands is my ultimate aim in my service to you.

Home Care Plan
At most one to one sessions with me I will deliver via email or SMS a Home Care Plan. This plan is designed to support you in the in-between weeks before your next appointment. It is not a compulsory requirement to complete all suggested tasks, merely to act as a guide and for you to use your best judgment as to how you wish to proceed in your healing journey. As your Home Care Plan is specific to your current needs at the time, I ask that you do not share this information with others. Please remember that I am always willing to help so if you need clarification on your Home Care Plan email me at support@withlovefromtess.com.au

Honesty
Openness and honesty is best practice. For you to receive the best results from my work an open and honest discussion of your needs will give us both a good framework from which to begin our treatment/sessions/group work together.

RISKS
From past client experience, deep emotional work can be triggering. As we are working with the body’s needs, it can come as a surprise when emotions come forward. If there has been a change in your health circumstances, such as pregnancy, a change to your prescription medication, or a new health development please let me know so that I can record these changes. If you are currently under the care of a health professional please do not change from the suggested care plan or medication.

LIMITATIONS and Professional Advice
Be aware that I am not a  qualified doctor of medicine or a therapist. I offer healing at a quantum level. If you are concerned with a change or new development to your current mental health or physical health status, please seek professional advice. If you are concerned with a change to your emotional well-being I strongly recommend you seek advice from a mental health professional.

SUITABILITY
The one to one work and group session work requires a certain amount of self-responsibility and personal power. A willingness to engage and share. If a young person or child is seeing me, the adult in question would need to be open and honest and also allow the young person or child to share their thoughts and views on an issue. I have a duty of care to each client and if children are under the age of 15 and I believe there is a risk to their well-being I will immediately report this to the parent or guardian in question.

CHILDREN
Some children aged 9 years and beyond, can enjoy discussing their private thoughts and feeling without a related adult in the room. Before I agree to this I will check with the child in question and gain permission with the consenting adult before adhering to the request of the child.

UNSUITABILITY
“You might not be a good fit for this work if you are currently experiencing deep emotional distress and are unable to take instruction or direction that may be required so that I may perform my work to the fullest capacity. Also if you are not fully engaged with or have difficulty in believing in the power and infinite capacity of the body to heal, suggestions and instructions will be met with resistance, lowering the possibility of you receiving the healing you may require.

 

Limitation of Liability

LIMITATION OF LIABILITY
I take my obligations under Australian Consumer Law seriously and will do my best to address any issues that arise. However, even if there is a major problem, my liability is strictly limited to:

– replacing the goods or providing the services again; or
– if I am unable to do so within a reasonable time, paying the cost of having the relevant goods or services supplied to you again.

If I am ill and unable to attend a scheduled meeting I will reschedule the call/class or appointment with you.

If you are unable to attend a session/ class or call please know that I will do my best to accommodate you. Please see the refund policy for individual circumstances. It may depend on the session type and cancellation policy for you to be eligible for a refund. .

If an electronic download, or a PDF that refuses to open, or a link that expires while your internet is down, myself or my staff will do their very best to restore this in good time. . If the internet cuts out half-way through a call, I will endeavour to re-establish the call with you as soon as possible.

If there is a problem outside human control, I will do my very best in the circumstances to rectify the problem if possible.

 

INVITATION TO DISCUSS PROBLEM
If you feel that there is any problem with your purchase, please let me know within 24 hours or before the end of the session. I am keen to understand what has gone wrong if you are unhappy so that I can address your concerns and try to find a mutually acceptable solution. WAIVER

I do not make any guarantees or warranties about the accuracy of any material displayed on this website, with the exception of any non-excludable consumer guarantees and other consumer protection provisions set out in the Australian Consumer Law. I am human and errors creep in despite the best of intentions. If you see something that doesn’t seem right, please let me know.

While I make all reasonable efforts to ensure that this website and my services/products meet with the highest standards of best practice, if something does go wrong that is not a direct result of my negligence, misrepresentation or deliberate fault, you agree that, to the fullest extent permitted by law, I will not be liable for any loss or damage arising out of or related to my  website, any products or services purchased through it, or any material posted on it, irrespective of whether such damages were foreseeable, and regardless of the nature of the claim.

The Implementation of My Advice
You take full responsibility for your implementation of any suggestions that I may make while providing my services. You understand that my advice is limited to providing you with options for your consideration, and that you are solely responsible for any actions that you choose to take.  Always consult your own values and vision, do your own research, and check with appropriately qualified professionals before making major decisions or making significant changes. You agree to indemnify me against all consequences arising directly or indirectly from your choices. 

You expressly agree that if this limitation of liability is unenforceable for any reason, my total cumulative liability for all causes of action of any kind shall not exceed the amount that you have paid to me for my products and or services.

 

Intellectual Property

COPYRIGHT
You may store, print and display the publicly available content supplied solely for your own personal use. This means copying or downloading is ok, but only for personal use, not commercial. If you are a student participating in my training, course content may be printed or downloaded to a local hard disk strictly for your personal and non-commercial use. Course content contains my trade secrets that are offered exclusively to students. It is an essential condition of participation that you agree that you will not provide extracts of any course content to anyone else under any circumstances.

Commercial exploitation of my content in any way that competes with my business is strictly prohibited.

You are welcome to share blog posts or other publicly available content through social media, but you must provide a link back to this website.

Payment Terms

FORMS OF PAYMENT
All sessions are to be paid for in full upfront before commencement of work. To make things easier I have a fully automated booking link (Acuity) which will safely and securely store your personal information. Your details will never be shared or moved to a third party platform without your express consent.

All payments made through this website are processed using Stripe and EFT is preferred from Australian customers to avoid Stripe fees.

 

SECURITY POLICY
I do not have access to your account details. Any financial information you enter is stored under Stripe’s security policy: https://stripe.com/docs/security/stripe.

 

PAYMENT TERMS
Currently all session, classes and programmes is invoiced in advance There may be occasion where I send my invoice after the consultation or when the work is complete. Payment is due within 14 days of the date on the invoice. If I have not received payment after 14 days, I will send you a reminder. I will continue to send weekly reminders after that until payment is received. After the first reminder, an administrative fee of $27.50 (inc. GST) will be added to the total amount due for every reminder sent. This is because having to nag you for my payment is not pleasant. If there is a problem with payment, please contact me as soon as possible to make alternative arrangements and avoid incurring this administrative fee. If an invoice is more than 90 days overdue, you agree to pay all costs, including debt collection agency fees and solicitor’s costs that I may incur in taking steps to recover any money that you owe to me whether or not legal proceedings are issued in relation to the debt.

 

PAYMENT PLANS
Payment plans are offered for your convenience only, so you can spread your payment out over time. You are still committed to paying the whole amount, even if you change your mind about completing the program, as you have had access to my intellectual property. It is your responsibility to ensure you have sufficient funds to make payment instalments on time. If a payment is overdue by more than 48 hours, access to the program content will be suspended until your payments are up to date. If your payment is more than 7 days overdue and you have not contacted me to make alternative arrangements, the payment plan will be cancelled, I will send you an invoice for the whole amount remaining, and my normal payment terms will apply to that invoice.

 

Delivery [and Shipping]

DELIVERY
All online sessions are held in privacy and respect due to the nature of the treatment using Zoom. Zoom installation and instructions are found on your appointment email. If an “I’m Ready to Chat” booking is made I will call you. If you do not respond at the appointment time, I will send you an SMS to let you know that I will try again in a few minutes. If for some reason I cannot make this call due to unforeseen circumstances, I will do my best to reschedule our time together and reschedule your appointment through Acuity.

In person sessions are to be scheduled through Acuity. Please wear comfortable clothing to your session with me. During Art of Feminine Presence workshops, you may be asked to wear something feminine (soft or flowing) to class.

Please turn off all notifications and ensure that you are in a private space that you will not be interrupted. If sessions are over 1.5 hours and a comfort break is needed, please let me know and we will resume the session upon your return. Wear comfortable clothing and be in an upright supported position on your couch or bed. If you decide to take the call/class or session time outdoors please make sure that you have adequate audio via a headset or wireless earphones.

 

SHIPPING
Products shipped with incur a shipping fee at checkout, unless free shipping is advertised on the product. We will ship to PO, with the understanding that it will be your responsibility if there is a return. Depending on the value of the product, express shipping and tracking may be required. I will let you know if this is the case on a product by product basis. I use Australia Post for all of my local and interstate shipping and will use a reputable international shipping company when required.

All items shipped will be packaged and handled with care prior to delivery. If you should receive an item in an unsatisfactory way please contact me on support@withlovefromtess.com.au.

 

Appointment Policies

APPOINTMENTS
I understand that sometimes there may be forces beyond your control when it comes to making appointments, in person or online. Please be aware that I will view each case individually and make a decision to reschedule your time with me if you provide me with notice within 24 hours. Acuity also has a rescheduling feature available to you should you change your mind 48 hrs prior to your appointed time.

If you fail to attend your online or in person appointment on the day and I am unable to reach you, you will forfeit your payment for that session to cover my expenses.

Please contact me if you are running behind, 10 – 12 minutes is acceptable but any longer and you may not receive the full level of care that you deserve as I will be committed to my next client/appointment.

 

Refund Policy

CHANGE OF MIND

For Kinesiology Services:
I do not offer a refund if you change your mind, so you are encouraged to consider carefully whether a purchase is right for you before you make your payment.

For Product Purchases:
I do not offer a refund for change of mind, but if you are not happy, please contact us for a credit to be used on my other products or services.

For Classes, Circles and Workshops:
I do not offer a refund if you change your mind, so you are encouraged to consider carefully whether a purchase is right for you before you make your payment.

 

ORDER FULFILMENT POLICY
If a product which you have ordered is unavailable or out of stock we will contact you and organise a replacement product of equal value.

 

REPLACEMENT PRODUCTS
If a product shipped to you by us is faulty or arrives damaged, please take a photo and send it through to us at support@withlovefromtess.com.au. We generally keep back up products in stock, but if they are a limited edition it may be difficult for us to honour the exact product. We will supply you with a product of equal value. Please keep your receipts for verification.

 

CANCEL ONGOING SUPPLY
If you change your mind with an ongoing membership with one of our monthly subscriptions please let us know at support@withlovefromtess.com.au. If you have signed up for one of our longer programmes ( 5 week, 8 week, or 6 months) please contact us to discuss your reservations or concerns so that we can calculate a refund for your contracted time within the programme. Please be aware that a full refund may not be possible if you have accessed some or all of the services or products you have paid for.

SPECIFIC TERMS OF SALE If you have purchased one of our special hand made products, please make sure that all safely advice on the correct usage of the products are adhered to. Be aware that although we take all care to ensure that your product arrives to your door in protective wrapping (for online sales) please see our returns policy above to arrange a refund or swap.

Dispute Resolution & Jurisdiction

NEGOTIATION
If you have any concerns, issues or complaint arising out of your use of this website, my products or services, or these terms and conditions, you agree to communicate with me with the intention of making a genuine effort to seek a win/win solution and trying to resolve the dispute in good faith through negotiation and discussion. Please email me at support@withlovefromtess.com.au and expect a response within 2 business days.

MEDIATION
“We” below refers to everyone involved in the dispute. If the dispute cannot be resolved by negotiation and discussion within 14 days, we agree to proceed to mediation with the assistance of an independent accredited mediator, seeking mediation online or by telephone if we are not both geographically located within 100kms of each other. The mediator is to be appointed by agreement between us or, failing agreement within 21 days of the negotiation period ending, the person initiating the dispute will seek the appointment of a dispute resolution professional by the President of the Law Society of Western Australia or similar neutral authority. We agree to share all the costs of mediation equally between us. We agree that neither of us will commence legal action until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted.

If you have a dispute with a doTERRA product purchased from my store, and I am unable to satisfy your complaint, please refer directly to doTERRA by contacting member services on 02 80155080.

NON-DISPARAGEMENT
If a dispute arises, we all agree that we will not engage in any public discussion about the issues, we will behave politely towards each other, and we will avoid any conduct or communication which might reasonably be expected to unreasonably interfere with any other person’s business or personal interests.

JURISDICTION  
This agreement is subject to the governing law of Western Australia. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, the courts of Western Australia, and the Commonwealth of Australia, will have exclusive jurisdiction.
